Hello, this is a request for the help of every collector out there. What this is about is the Toy Fare "Exclusive" release of the glow in the dark Undertaker figure. I suggest you read this all to get all the details. If you already know the story of how we've all been ripped off by the re-release of the Exclusive Undertaker figure, you may skip down to the section after the ****. For those of you who don't know the story, let me take a second to fill you in. In the April issue of Toy Fare magazine, they offered an "exclusive" Undertaker figure. It was only available through mail order through the magazine. The price was $12 per figure which is a flat out rip off since most every store that handles Jakks products charges between 3.99 and 5.99 for the same style figures. So why would some one pay $12 for a figure? Because that was the ONLY way to get that figure. So people buy the figure because that's the only way to get it, and by calling it Exclusive, Toy Fare claims you won't find it elsewhere. A pretty crappy way to take advantage of the people that read their magazine, but it's their right to do that. What is not their right is releasing the figure elsewhere. When they claim it's Exclusive, they lose the right to release it in any other set, series, or any other way. However, this didn't stop them, Jakks released the EXACT same figure in the 2 Tuff 5 Series with the Vicera figure. It is the EXACT same, there is no difference. How do they get away with it you ask, because they figure that since were only talking about toys, no one will do anything about it. Who's gonna bring them to court over a $12 toy? Besides there just dealing with a bunch of dumb kids, right? WRONG. Thats where you come in. Now I've never claimed to be the world's smartest man, but this I know. #1 it's wrong to take advantage of people. By claiming that their magazine is the only place to get that figure and charging $12, then allowing it to be re-released in a $10 set giving it an individual value of $5, that's taking advantage of us. #2 I also know that there's strength in numbers. I can't win this war alone, I need all your help. We can make a difference, we just have to get off our butts and do some thing (actually you can remain on your butt if you're online).
***************************************************************
So what can we do? First, I don't know who's at fault, I don't know if Toy Fare was wrong for calling it Exclusive, or if Jakks was wrong for re-releasing it. But since Toy Fare just used their "he's just a dumb kid" logic on me and didn't bother to respond to my several attempts to contact them, and since I bought the figure from Toy Fare, it's them I hold responsible. If Jakks violated the deal with Toy Fare, that's Toy Fare's problem. We bought the figure from Toy Fare. OK, here's what we can do. Every one can contact the Better Business Bureau at www.bbb.org and file a complaint. Every one who bought a Toy Fare exclusive Undertaker should get a refund or a replacement with a real Exclusive figure. For those of you who don't remember the address, we all had to send the money to:
Wizard Entertainment Group
Drawer W
P.O. Box 10000
Bealeton, VA 22712
Toy Fare on line can be reached at www.toyfare.com
E-MAIL ToyFanFare@aol.com OR CLICK HERE
Toy fare is still advertising the figure as "Exclusive glow in the dark figure" on their web site AND the figure was still called exclusive and for sale for $14 in the October Issue.
If we don't all get together and do something, no one will stop them. Please, I urge you to file a complaint. Even if you didn't buy one from Toy Fare, there's a box at the bottom of the form that says "just for BBB records". We have to show them that were not just a bunch of punks who will be taken advantage of and just say nothing. Please, file a complaint. It will take a minute of your time, but it'll be worth it to stop Toy Fare and their School Yard Bully style.
Any one who does this, or if you have a better idea, please let me know. Also, please help us be taken seriously by acting mature when filing a complaint. Please don't curse or use "net slang" (i.e. 4=for, 2=to, ect...) like we all do to save time in E-mail's to each other. The last thing we want to do is make ourselves look like the dumb kids or defenseless adults that Toy fare apparently already thinks we are. Thanks a lot for reading and thanks in advance for your help. Please send this page to every one you know that bought one of these figures and any other collectors to go file a complaint with you. Other web pages please help in the fight also. Feel free to link direct to this page. The Direct address is:
